A bi-partisan bill working its way through Congress could drastically change how copyright claims are processed, and would create a system to impose up to $30,000 in fines on anyone who shares protected material online.

In other words, the Congress wants to make it easier to sue people who send a meme or post images that they didnt create themselves, essentially a giveaway to lawyers who sue unsuspecting suckers for a living.

The Senate Judiciary Committee last week approved the Copyright Alternative in Small-Claims Enforcement Act of 2019, which creates a voluntary small claims board within the Copyright Office that will provide copyright owners with an alternative to the expensive process of bringing copyright claims, including infringement and misrepresentation . in federal court, according to the Copyright Alliance.

This new board, called the Copyright Claims Board (CCB), would allow recovery in each case of up to $30,000 in damages total, with a cap of $15,000 in statutory damages per work infringed, according to the alliance, an advocacy group for the copyright industry.

Critics contend the CCB created would essentially provide a way for copyright trolls to target individuals or small businesses to secure five-figure default judgements for innocent mistakes. Put another way, someone who shares memes they didnt make could be on the hook for $30,000 in fines from folks who make a living from copyright lawsuits.

A petition on ActionNetwork.org opposing the CASE Act explains:

Have you ever shared a meme that you didnt make? Or downloaded a photo you saw on social media? If Congress has its way you could soon get slapped with a $15,000 fine by copyright trolls with no chance of appeal just for doing normal stuff on the internet.

These trolls buy up copyrights with the sole intent of sending out mass threats and lawsuits to harvest settlements. Now, a dangerous new bill called the Copyright Alternative in Small Claims Enforcement Act is sailing through Congress to make it easier for everyone from trolls to Hollywood producers to sue you.

In recent years, federal courts have made it easier for regular people to defend themselves from frivolous lawsuits by trolls. But the CASE Act would create a separate, industry-friendly system for copyright claims to $30,000, with no option of appeal.

 

The Electronic Frontier Foundation reported when the legislation was first introduced in 2017 that those pushing for the bill mostly include photographers and other visual artists looking for a cheaper alternative to federal courts to pursue claims, which can be expensive.

But the reality is the CASE Act would significantly lower many of the legal hurdles that protect citizens from overzealous copyright lawyers in a variety of ways, from allowing claims for works that arent registered, to the ability to unmask alleged infringers without the same standards as federal courts, the power for the CCB to create its own rules, limited due process for claims below $5,000, and an opt-out approach that can be confusing for folks who cant afford expensive lawyers.

The CASE Act also allows claimants to collect fines without showing actual harm from a copyright violation, and leaves those trapped in the system with little recourse.

Its true that federal litigation for small-dollar-value disputes generally isnt practical. The federal courts impose costly, sometimes unnecessary burdens on nearly all who use them. But much of that expense comes from procedures that promote fairness, established and refined through years of use in all types of cases, not copyright infringement suits alone, EFF reports.

 

Creating a parallel track that allows copyright holders to dispense with those procedures as a privileged category of litigants just doesnt make sense.

It lacks meaningful opt-in consent for all parties, structural safeguards against abuse, and legal accountability through a right of appeal. The bill would allow an unappealable tribunal to assign damages of up to $30,000, or nearly half the income of the average American household. A tribunal with that kind of punitive power must be accountable. The system envisioned by the CASE Act is not, said Meredith Rose, counsel for Public Knowledge, a public interest nonprofit that promotes open internet.

Moreover, we are deeply disturbed by the lack of process surrounding the consideration of this bill. The Senate Judiciary Committee passed the bill today without any hearings on its content, and without any opportunities for all stakeholders to voice their concerns. For any bill let alone one that could drive the average American household into bankruptcy this lack of transparency is inexcusable.

The CASE Act is now awaiting a vote before the full Senate.

Many of Trump's businesses have flown under the radar. Indeed, Trump has full or partial ownership of approximately 500 companies in the United States alone. Many of these companies focus their efforts on developing Trump's real estate ventures abroad, although they are headquartered in the U.S.

The very fact that I see him bask in statements that he is the "King of Isreal" and constantly keep bragging, knowing damn well he is batting for the banks to get interest free loans (or even worse yet banks getting PAID to borrow money) while the rest of us are all paying 3.9% to 29.99% respectively is enough for me to pause and think! Here is a man that has admitted that he has never done or donated to a cause that he didn't expect a favor in return for! Here is a guy who is donating his entire paycheck to Government agencies, and I suppose him doing so means he can Govern however he see's fits because we all owe him? That would be a lot like walking into a restaurant and them refusing to take any money because you were going to eat what they wanted to feed you, cooked the way they wanted to cook it! If you go for that kind of thing then I don't see why socialist Democrat breadlines would be any different except to say I had health insurance if I got sick.

This idea that we all work harder because Trump and his 1% banker buddies are just soooo much smarter isn't sitting well with me. I blame President Trump for the current state of the financial market right now, which I find to be more weighted for the bankers and big industry than any time I can ever remember in history! I don't see the debt shrinking, I only see it increasing! Say what you want about Bill Clinton, but the man is the ONLY one who shrank the deficit. 

I see a lot of you in here putting blind trust into Trump and it worries me. I wonder at times if some of you are Russian plants because you can't be living in the same America that I am or you too would see! This is a wake up call for all of you AND Trump's big ego... This is America! On top of the world today but you can be on skid row tomorrow! The man has been married, what? Three times now? Doesn't say much for his loyalty to the people close to him. And by Trumps own standards of being a winner, five failures is too many! I like people who don't ever lose, he might be a loser!

So that is where my head is at right now folks... Sleepy Joe might just be the answer to our Greedy Trump problem.

1st off, there will be no civil war here in America! Hate to pop your little bubble.. No one is going to war to save Trumps self-serving ass that much I can assure you.

2nd, the drop in interest rates are because Trump gave Big Business and the 1% a massive tax break and had to slap tariffs on China to offset the lost revenue. Don't you for one minute think anyone else sees it any different.

Furthermore, rising interest rates are GOOD because it means people are making money you stupid motherfucker! When interest rates are at or below zero it's because things ARE NOT GOOD! And when things are not good property values fall, and when property values fall banks just quit lending! Don't even try to deny it Nuffan! When the last housing market crash happened the market was FLOODED with homes as low as .25 cents on the dollar! Do you think banks were lending then? HELL NO! They were selling to their wealthy clientele at .10 cents on the dollar and bilking the American tax payer for deductions on the other .90 cents + cost! You must really be brainwashed or you have gotten so old you cant even remember back 10 years! Higher interest rates hurt big business and the rich WAY MORE than they hurt the poor because they aren't getting loans anyway! Oh sure, he talks the talk but from where I am standing he sure as hell isn't walking the walk! When Obama talked about stepping on the throats of bankers, that was the kind of talk that was being projected from a "self-made" man, something Trump will never understand and could never be.

Do I think Trump is racist? No, I think he hates everyone just as much. He would rub elbows with anyone to advance his agenda! Does that make him a bad person? Perhaps at the least shallow and selfish.

Trump is totally fine with Americans feeling a little pain while he fucks around with China at Americans peril. He promised infrastructure and yet is talking about buying Greenland? WTF!? That don't even make any sense either! Strategically speaking we already have a base in Greenland so why the fuck do we need to spend billions more for another liability?!

Yes I am laying this at Trumps feet because he is a fool if he thinks what he's doing is going to win him votes in 2020! I don't see no big expansion of manufacturing here in the USA! In fact US Steel in Michigan is laying off a whole lot of people and many automotive plants are closing all over the country. Why don't you wake up and smell what you are shoveling! 

Trumps ego is writing checks his ass can't cash! I'd like to say I did right by America in voting for the best candidate when the time comes and even if we just used Trump to get everyone back to the table while more level heads ironed out a deal that was in the best interest of the people then so be it! I'd much rather America get the better of Trump than Trump get the better of America! If Trump was serious about what he said we wouldn't see plants closing, we would see expansion - BANKS WOULD BE LENDING! But they aren't and he isn't!

If he thinks his dog any pony show is going to cut the mustard for another year going on this way, expecting Americans to feel some pain while his fat ass sits up in the White House living like a king, well let me just say this "Read my lips - Americans don't do pain at the polls".

I am loyal to my party and my President and that is why I am giving it to you straight! You don't like it!? WELL FUCKING CHANGE IT!
